These Terms & Conditions (“Terms”) govern your use of the AvaCare website https://avacares.xyz and the AvaCare iPhone app (the “Services”), operated by [COMPANY LEGAL NAME] (“AvaCare”, “we”, “us”). By creating an account or placing an order you agree to these Terms.
1. Eligibility and accounts
- You must be at least 18 years old to create an account and place orders.
- You are responsible for keeping your login details and OTP codes confidential and for all activity on your account.
- Please give accurate name, phone and delivery information. We may suspend accounts that use false information or misuse the Services.
2. Medicines and prescriptions
- Prescription medicines are dispensed only against a valid prescription from a registered medical practitioner, as required by the laws of Bangladesh. We may ask you to upload or show the original prescription.
- Our pharmacist may refuse, reduce the quantity of, or cancel an order if the prescription is invalid, unclear or the order appears unsafe.
- Information on the Services is for general guidance only and is not medical advice. Always follow your doctor’s advice and read the product label. In an emergency contact your doctor or the nearest hospital immediately.
- Controlled and restricted medicines are not sold through the Services except as permitted by law.
3. Products, prices and availability
- Prices are in Bangladeshi Taka (৳) and include applicable VAT unless stated otherwise. Delivery charges are shown at checkout.
- Product images are for illustration; packaging may differ from the image.
- Prices, offers and stock may change without notice. If a product is unavailable or priced incorrectly, we will contact you and you may cancel the order for a full refund of any amount paid.
4. Orders and payment
- An order is confirmed when we accept it and notify you. We may cancel orders in case of stock issues, pricing errors, suspected fraud or prescription problems.
- Payment may be made by cash on delivery or by the online methods shown at checkout. Online payments are processed by third-party payment partners.
5. Delivery
We deliver to the areas shown at checkout. Delivery times are estimates and may be affected by location, weather, holidays or other events outside our control. Please check the product and expiry date when you receive your order.
6. Returns, refunds and cancellations
Returns and refunds are handled under our Refund & Returns Policy. For safety reasons, medicines that have left our control, opened items and temperature-sensitive products (such as insulin) cannot be returned unless they were damaged, wrong or expired on delivery.
7. Acceptable use
You agree not to misuse the Services, including by placing fraudulent orders, reselling prescription medicines, uploading false prescriptions, interfering with the website or app, or copying our content without permission.
8. Intellectual property
The AvaCare name, logo, website and app design and content belong to AvaCare or its licensors. Product names and brands belong to their respective owners.
9. Limitation of liability
To the extent permitted by law, AvaCare is not liable for indirect or consequential loss arising from your use of the Services. Our total liability for any order is limited to the amount you paid for that order. Nothing in these Terms limits your rights under the Consumer Rights Protection Act 2009 or other applicable law.
10. Account deletion
You may delete your account at any time from the app (More → Delete My Account) or at avacares.xyz/delete-account. See our Privacy Policy for how we handle your data.
11. Changes
We may update these Terms from time to time. The updated Terms will be posted on this page with a new effective date. Continuing to use the Services means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the People’s Republic of Bangladesh, and the courts of Dhaka have jurisdiction over any dispute.
